General Terms and Conditions (GTC)

  1. Scope of application

These General Terms and Conditions (hereinafter referred to as “GTC”) govern the contractual relationship between MaiQ AG (hereinafter referred to as “Provider”) and its customers (hereinafter referred to as “Customer”) in connection with the use of the services and products offered (hereinafter referred to as “Services”).

  1. Subject matter of the contract

The GTC apply to all services and products offered by the Provider to its Customers. This includes in particular the use of the all-in-one SaaS platform Test4Data (hereinafter referred to as the “SaaS platform”) and the tester platform Test4Cash (hereinafter referred to as the “tester platform”).

  1. Registration and access

Registration is required to use the platform. The customer on both platforms undertakes to provide truthful and complete information when registering. After successful registration, the customer shall receive access data, which must be treated confidentially and may not be passed on to third parties.

  1. Services of the provider

The provider shall make the use of the SaaS platform available to the customer in accordance with the agreed conditions. This includes in particular the provision of testing options for digital products as well as AI-based tests and data analyses. The customer can make payments via this SaaS platform in accordance with the offer; this implies payment for the test persons as well as the software. The provider also makes the tester platform available to the customer (test persons), via which various products can be tested, evaluated and viewed according to specifications and for which the customer can earn predefined money. This money can be withdrawn by the customer via the tester platform and paid out to their private account.

  1. Use of the platform

The customer undertakes to use the platform exclusively for legal purposes and not to publish any content that violates applicable law or infringes the rights of third parties. If the customer requests a confidentiality agreement from the test subjects, this must be strictly adhered to and may not be breached.

  1. Fees and terms of payment

The use of the SaaS platform is subject to a fee. The amount of the fees depends on the agreed tariffs and payment modalities. Payment is made (monthly/annually) in advance and can be processed directly via the platform itself. The provider reserves the right to make any price adjustments. The customer will be informed of any changes in good time.

  1. Liability

The provider is only liable for damages caused by gross negligence or intent. Liability for indirect damages, loss of profit or insufficient tester feedback is excluded.

  1. Data privacy

The provider undertakes to comply with the applicable data protection regulations. Further information on the handling of personal data can be found in the provider’s privacy policy.

  1. Intellectual property

All rights to the platforms and the content provided on them remain with the provider or its licensors. Use of the two platforms or the content beyond the contractually agreed conditions is not permitted.

  1. Amendment of the GTC

The Provider reserves the right to amend the GTC at any time. The customer shall be notified of any changes in good time and shall be deemed to have approved them unless the customer objects within a reasonable period of time.

  1. Final provisions

Should individual provisions of these GTC be invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes closest to the economic purpose of the invalid or unenforceable provision.

Storage: The personal data you provide will be collected and stored for the internal use of MaiQ and for the purposes of recruitment and service provision.

5. Your privacy rights

You have certain rights based on the applicable data protection law. We will respond to your request without undue delay and in any event within one calendar month of receipt. Please note that we may ask you to verify your identity before responding to such requests.

Right of access You have the right to request a copy of the personal data stored by us as data controller, which we will provide to you in electronic form.
Right to change You have the right to ask us to correct our records if you believe they contain incorrect or incomplete information about you.
Right to withdraw consent

If you have given your consent to the collection, processing and disclosure of your personal data, you have the right to withdraw your consent in whole or in part. This also applies to cases where you wish to unsubscribe from marketing messages.

Once we have received notification that you have withdrawn your consent, we will no longer process your data for purposes to which you originally consented, unless there is another legal basis for the processing. 6. Use of Meta

(1) We use Instagram for branding and test person acquisition and have integrated a link to our Instagram presence on our website.

(2) The operating company of Facebook is Facebook, Inc. with its registered office at 1 Hacker Way, Menlo Park, CA 94025, USA. If a data subject lives outside the USA or Canada, the controller for the processing of personal data is Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

7. Use of LinkedIn

We use functions of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. Each time one of our pages containing LinkedIn functions is accessed, a connection to LinkedIn servers is established. LinkedIn is informed that you have visited our website with your IP address. If you click on the LinkedIn “Recommend button” and are logged into your LinkedIn account, LinkedIn is able to associate your visit to our website with you and your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by LinkedIn.
